This website is operated by Apnaugao Pvt. Ltd. (“we”, “us” or “our”). By accessing or using apnaugao.com (the “Site”), including purchasing products from us, you agree to be bound by these Terms of Service (“Terms”), along with our Privacy Policy, Return and Refund Policy, and Shipping Policy.

If you do not agree to these Terms, you may not access the Site or use our services.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform that lets us sell our products and services.

1. Eligibility & Use of the Site

By using this Site, you confirm that:

  • You are at least 18 years old, or are using the Site under the supervision of a parent or legal guardian
  • You will not use our products or services for any illegal or unauthorised purpose
  • You will comply with all applicable laws and regulations

Any violation of these Terms may result in immediate termination of your access to the Site.

2. General Conditions

  • We reserve the right to refuse service to anyone at any time for any lawful reason
  • Content you submit (excluding payment information) may be transferred unencrypted over networks
  • Payment information is always processed securely and encrypted
  • You may not copy, resell, exploit or misuse any part of the Site or Service without written permission

3. Product Information & Availability

  • Products are sold through our online store. Lahore customers may also collect orders from our Gulberg store. Some products may be available in limited quantities.
  • Seeds and some other products are seasonal, and availability may change during the year
  • All product descriptions, prices and availability are subject to change without notice
  • We do our best to display product colours accurately, but cannot guarantee how they appear on your screen
  • We reserve the right to limit or cancel orders at our discretion

Returns are governed by our Return and Refund Policy. Delivery is governed by our Shipping Policy.

4. Orders, Billing & Account Information

  • We reserve the right to refuse or cancel any order
  • You agree to provide accurate, current and complete billing, delivery and contact information, including a working phone number
  • Some orders require full or partial advance payment before dispatch, as described in our Payment Conditions and Partial Payment Policy
  • We may cancel orders that appear fraudulent or unauthorised, or that are placed for resale without prior agreement with us

If an order is cancelled or changed, we may try to notify you using the contact details you provided.

5. Pricing & Service Modifications

  • Prices may change without prior notice
  • We may modify or discontinue any product or service at any time
  • We are not liable for price changes, service interruptions or discontinued products

6. Third-Party Tools & Links

  • The Site may include tools or links provided by third parties
  • We do not control or endorse third-party websites or services
  • Use of third-party tools or links is at your own risk

7. User Content & Feedback

If you submit feedback, suggestions, reviews or other content:

  • You grant us the right to use, publish and distribute it without compensation
  • Your content must not be unlawful, misleading or abusive, or infringe third-party rights
  • You are solely responsible for the content you submit

Your submission of personal information is governed by our Privacy Policy.

9. Errors & Inaccuracies

We reserve the right to:

  • Correct errors, inaccuracies or omissions at any time
  • Cancel orders affected by incorrect pricing or information

We are not obligated to update information unless required by law.

11. Disclaimer of Warranties

Except for our Germination Guarantee and the commitments in our Return and Refund Policy, the Site, products and services are provided “as is” and “as available”, without warranties of any kind, express or implied.

Gardening results depend on factors outside our control, such as sowing season, climate, soil, watering and care. We cannot guarantee specific growth or harvest results.

We do not guarantee uninterrupted, secure or error-free service.

12. Limitation of Liability

To the maximum extent permitted by law, Apnaugao shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. For seeds that fail to germinate, our responsibility is limited to replacing the seeds as described in our Germination Guarantee.

Where liability cannot be excluded, it will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Apnaugao, its owners, employees and partners from any claims arising from your breach of these Terms or misuse of the Site.

14. Termination

These Terms remain in effect unless terminated by you or us. We may suspend or terminate access at any time if you violate these Terms.

All obligations arising before termination will survive termination.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain valid.

16. Entire Agreement

These Terms, along with the policies referred to in them, are the entire agreement between you and Apnaugao and replace any prior agreements.

17. Governing Law

These Terms are governed by and interpreted under the laws of Pakistan.

18. Changes to Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted means you accept the revised Terms.

What changed:

  • “Online only” is replaced with a line that mentions Gulberg store pickup.
  • The email is now hello@, and I added your WhatsApp number. The address now matches the one in your Privacy policy.
  • The reseller clause now only covers resale “without prior agreement.” The old wording let you cancel any reseller order, which clashed with the wholesale/bulk offer on your FAQ.
  • Payment rules now point to your advance-payment pages, so a customer can’t claim the Terms promised full COD.
  • Sections 11–12 now reference the germination guarantee. The old “no warranties of any kind” line contradicted the free seed replacement you promise, and the new wording limits your liability to replacing the seeds.
  • Formatting: I fixed the broken & characters in the headings.
